mewujudkan kegiatan Perdagangan Berjangka yang teratur, wajar, efisien, dan efektif serta dalam suasana persaingan yang sehat; melindungi kepentingan semua pihak dalam Perdagangan Berjangka; dan mewujudkan kegiatan Perdagangan Berjangka sebagai sarana pengelolaan risiko harga dan pembentukan harga yang transparan.

Dalam melaksanakan ketentuan sebagaimana dimaksud dalam Pasal 4 dan Pasal 5, Bappebti berwenang :

membuat penjelasan lebih lanjut yang bersifat teknis atas Undang-undang ini dan/atau peraturan pelaksanaannya; memberikan : izin usaha kepada Bursa Berjangka, Lembaga Kliring Berjangka, Pialang Berjangka, Penasihat Berjangka, dan Pengelola Sentra Dana Berjangka; Izin kepada orang perseorangan untuk menjadi Wakil Pialang Berjangka, Wakil Penasihat Berjangka, dan Wakil Pengelola Sentra Dana Berjangka; Sertifikat pendaftaran kepada Pedagang Berjangka; Persetujuan kepada Pialang Berjangka dalam negeri untuk menyalurkan amanat Nasabah dalam negeri ke Bursa Berjangka luar negeri; dan Persetujuan kepada bank berdasarkan rekomendasi Bank Indonesia untuk menyimpan dana Nasabah, Dana Kompensasi, dan dana jaminan yang berkaitan dengan transaksi Kontrak Berjangka serta untuk pembentukan Sentra Dana Berjangka; menetapkan daftar Bursa Berjangka luar negeri dan Kontrak Berjangkanya; melakukan pemeriksaan terhadap Pihak yang memiliki izin usaha, izin orang perseorangan, persetujuan, atau sertifikat pendaftaran; menunjuk pihak lain untuk melakukan pemeriksaan tertentu dalam rangka pelaksanaan wewenang Bappebti, sebagaimana dimaksud pada huruf d; memerintahkan pemeriksaan dan penyidikan terhadap setiap Pihak yang diduga melakukan pelanggaran terhadap ketentuan Undang-undang ini dan/atau peraturan pelaksanaannya; menyetujui peraturan dan tata tertib Bursa Berjangka dan Lembaga Kliring Berjangka, termasuk perubahannya; memberikan persetujuan terhadap Kontrak Berjangka yang akan digunakan sebagai dasar jual beli Komoditi di Bursa Berjangka, sesuai dengan persyaratan yang telah ditentukan; menetapkan persyaratan dan tata cara pencalonan dan memberhentikan untuk sementara waktu anggota dewan komisaris dan/atau direksi serta menunjuk manajemen sementara Bursa Berjangka dan Lembaga Kliring Berjangka sampai dengan terpilihnya anggota dewan komisaris dan/atau anggota direksi yang baru oleh Rapat Umum Pemegang Saham; menetapkan persyaratan keuangan minimun dan kewajiban pelaporan bagi Pihak yang memiliki izin usaha berdasarkan ketentuan Undang-undang ini dan/atau peraturan pelaksanaannya; menetapkan batas jumlah maksimum dan batas jumlah wajib lapor posisi terbuka Kontrak Berjangka yang dapat dimiliki atau dikuasai oleh setiap Pihak; mengarahkan Bursa Berjangka dan Lembaga Kliring Berjangka untuk mengambil langkah-langkah yang dianggap perlu apabila diyakini akan terjadi keadaan yang mengakibatkan perkembangan harga di Bursa Berjangka menjadi tidak wajar dan/atau pelaksanaan Kontrak Berjangka menjadi terhambat; mewajibkan setiap Pihak untuk menghentikan atau memperbaiki iklan atau kegiatan promosi yang menyesatkan berkaitan dengan Perdagangan Berjangka dan Pihak tersebut mengambil langkah-langkah yang diperlukan untuk mengatasi akibat yang timbul dari iklan atau promosi dimaksud; menetapkan ketentuan tentang dana Nasabah yang berada pada Pialang Berjangka yang mengalami pailit; memeriksa keberatan yang diajukan oleh suatu Pihak terhadap keputusan Bursa Berjangka atau Lembaga Kliring Berjangka serta memutuskan untuk menguatkan atau membatalkannya; membentuk sarana penyelesaian permasalahan yang berkaitan dengan kegiatan Perdagangan Berjangka; mengumumkan hasil pemeriksaan, apabila dianggap perlu, untuk menjamin terlaksananya mekanisme pasar dan ketaatan semua Pihak terhadap ketentuan Undang-undang ini dan/atau peraturan pelaksanaannya; melakukan tindakan yang diperlukan untuk mencegah kerugian masyarakat sebagai akibat pelanggaran terhadap ketentuan Undang-undang ini dan/atau peraturan pelaksanaannya; dan melakukan hal-hal lain yang diberikan berdasarkan ketentuan Undang-undang ini dan/atau peraturan pelaksanaannya.

Bappebti mengenakan biaya kepada Pihak atas kegiatan pelayanannya dalam memberikan izin, persetujuan, dan kegiatan lain. Ketentuan dan besar biaya sebagaimana dimaksud pada ayat (1), diatur lebih lanjut dengan Peraturan Pemerintah.

Undang - Undang Republik Indonesia Nomor 32 Tahun 1997 : Bab III Bursa Berjangka Dan Lembaga Kliring Berjangka.

Perizinan dan Bentuk Hukum.

Bursa Berjangka didirikan oleh sejumlah badan usaha yang satu dengan lainnya tidak berafiliasi. Pendiri sebagaimana dimaksud pada ayat (1) merupakan anggota pertama Bursa Berjangka. Yang dapat menjadi pemegang saham Bursa Berjangka adalah Anggota Bursa Berjangka yang bersangkutan. Pedagang Berjangka wajib memperoleh sertifikat pendaftaran dari Bappebti sebelum diperkenankan melakukan kegiatan perdagangan di Bursa Berjangka.

Kegiatan transaksi Kontrak Berjangka hanya dapat dilakukan di Bursa Berjangka yang telah memperoleh izin usaha dari Bappebti dan berdasarkan ketentuan Undang-undang ini dan/atau peraturan pelaksanaannya. Kontrak Berjangka hanya dapat ditransaksikan di Bursa Berjangka setelah ketentuan dan persyaratannya mendapat persetujuan dari Bappebti. Penerbitan Opsi hanya dapat dilakukan oleh Pihak yang telah memperoleh persetujuan dari Bappebti.

Bursa Berjangka dapat menyelenggarakan transaksi fisik komoditi yang jenisnya sebagaimana diatur dalam Pasal 3.

Tugas, Kewajiban, dan Wewenang.

Bursa Berjangka bertugas: menyediakan fasilitas yang cukup untuk dapat terselenggaranya transaksi Kontrak Berjangka yang teratur, wajar, efisien, dan efektif; Menyusun rencana anggaran tahunan dan penggunaan laba Bursa Berjangka sesuai dengan ketentuan yang ditetapkan oleh dan dilaporkan kepada Bappebti; dan Menyusun peraturan dan tata tertib Bursa Berjangka.

Bursa Berjangka wajib: memiliki modal yang cukup untuk menyelenggarakan kegiatan Bursa Berjangka dengan baik; menyiapkan catatan dan laporan secara rinci seluruh kegiatan Anggota Bursa Berjangka yang berkaitan dengan transaksi Kontrak Berjangka dan penguasaan Komoditi yang menjadi subjek Kontrak Berjangka tersebut; menjamin kerahasiaan informasi posisi keuangan serta kegiatan usaha Anggota Bursa Berjangka, kecuali informasi tersebut diberikan dalam rangka pelaksanaan ketentuan Undang-undang ini dan/atau peraturan pelaksanaannya; membentuk Dana Kompensasi; mempunyai satuan pemeriksa; mendokumentasikan dan menyimpan dengan baik semua data yang berkaitan dengan kegiatan Bursa Berjangka; menyebarluaskan informasi harga Kontrak Berjangka yang diperdagangkan; memantau kegiatan dan kondisi keuangan Anggota Bursa Berjangka serta mengambil tindakan pembekuan atau pemberhentian Anggota Bursa Berjangka yang tidak memenuhi persyaratan keuangan dan pelaporan, sesuai dengan ketentuan Undang-undang ini dan/atau peraturan pelaksanaannya. Pimpinan satuan pemeriksa sebagaimana dimaksud pada ayat (1) huruf e, wajib melaporkan secara langsung kepada direksi, dewan komisaris Bursa Berjangka, dan Bappebti tentang masalah materiil yang ditemukan, yang dapat mempengaruhi Anggota Bursa Berjangka dan/atau Bursa Berjangka yang bersangkutan. Bursa Berjangka wajib menyediakan semua laporan satuan pemeriksa setiap saat apabila diperlukan oleh Bappebti. Sebelum diberlakukan, peraturan dan tata tertib Bursa Berjangka sebagaimana dimaksud dalam Pasal 16 huruf c termasuk perubahannya, wajib memperoleh persetujuan dari Bappebti.

Bursa Berjangka berwenang : mengevaluasi dan menguji kualifikasi calon serta menerima atau menolak calon tersebut menjadi Anggota Bursa Berjangka; mengatur dan menetapkan sistem penentuan harga penyelesaian, bersama dengan Lembaga Kliring Berjangka; menetapkan persyaratan keuangan minimum dan pelaporan bagi Anggota Bursa Berjangka; melakukan pengawasan kegiatan serta pemeriksaan terhadap pembukuan dan catatan Anggota Bursa Berjangka secara berkala dan sewaktu-waktu diperlukan; menetapkan biaya keanggotaan dan biaya lain; melakukan tindakan yang dianggap perlu untuk mengamankan transaksi Kontrak Berjangka, termasuk mencegah kemungkinan terjadinya manipulasi harga; menetapkan mekanisme penyelesaian pengaduan dan perselisihan sehubungan dengan transaksi Kontrak Berjangka; mengambil langkah-langkah untuk menjamin terlaksananya mekanisme transaksi Kontrak Berjangka dengan baik serta melaporkannya kepada Bappebti; dan memperoleh informasi yang diperlukan dari Lembaga Kliring Berjangka yang berkaitan dengan transaksi yang dilakukan oleh Anggota Lembaga Kliring Berjangka.

Kegiatan transaksi di Bursa Berjangka dapat dihentikan sementara waktu, baik untuk sebagian maupun seluruh Kontrak Berjangka, apabila terdapat hal-hal atau kejadian yang merugikan kepentingan masyarakat atau keadaan yang tidak memungkinkan diselenggarakannya kegiatan transaksi Kontrak Berjangka secara wajar.

Apabila penyebab penghentian sementara waktu transaksi seluruh Kontrak Berjangka sebagaimana dimaksud dalam Pasal 19 tidak dapat diatasi dalam jangka waktu tertentu, Bappebti menghentikan kegiatan Bursa Berjangka secara tetap dan mencabut izin usahanya. Sebelum menetapkan penghentian kegiatan Bursa Berjangka secara tetap sebagaimana dimaksud pada ayat (1), Bappebti wajib mempertimbangkan kepentingan masyarakat umum, Nasabah, Anggota Bursa Berjangka yang bersangkutan, dan lembaga lain yang berkaitan dengan kegiatan dan perizinan Bursa Berjangka. Tindakan sebagaimana dimaksud pada ayat (1) wajib dilaporkan oleh Bappebti kepada Menteri dan diumumkan secara luas.

Apabila izin usaha Bursa Berjangka dicabut, badan hukum Bursa Berjangka yang bersangkutan dibubarkan sesuai dengan peraturan perundang-undangan yang berlaku. 3Apabila terdapat sisa kekayaan hasil likuidasi Bursa Berjangka yang menjadi hak Pialang Berjangka sebagai pemegang saham, sisa kekayaan tersebut wajib digunakan terlebih dahulu untuk membayar kewajiban Pialang Berjangka yang bersangkutan kepada Nasabah.

Ketentuan mengenai persyaratan dan tata cara pendirian, perizinan, penghentian, dan pembubaran Bursa Berjangka sebagaimana dimaksud dalam Pasal 12, Pasal 13, Pasal 14, Pasal 19, Pasal 20, Pasal 21 dan Pasal 22 diatur lebih lanjut dengan Peraturan Pemerintah.

Lembaga Kliring Berjangka.

Lembaga Kliring Berjangka didirikan dengan tujuan mendukung terciptanya transaksi Kontrak Berjangka yang teratur, wajar, efisien, dan efektif di Bursa Berjangka.

Perizinan dan Bentuk Hukum.

Penyelenggaraan Bursa Berjangka dilengkapi dengan Lembaga Kliring Berjangka. Lembaga Kliring Berjangka, sebagaimana dimaksud pada ayat (1), adalah badan usaha berbentuk perseroan terbatas yang telah memperoleh izin usaha sebagai Lembaga Kliring Berjangka dari Bappebti. Izin usaha sebagaimana dimaksud pada ayat (2), hanya diberikan kepada badan usaha yang terpisah dari Bursa Berjangka dan bersifat mandiri.

Tugas, Kewajiban, dan Wewenang.

Lembaga Kliring Berjangka bertugas, antara lain : menyediakan fasilitas yang cukup untuk terlaksananya penyelesaian transaksi Kontrak Berjangka; dan menyusun peraturan dan tata tertib Lembaga Kliring Berjangka.

Lembaga Kliring Berjangka wajib: memiliki modal yang cukup untuk menyelenggarakan kegiatan Lembaga Kliring Berjangka dengan baik; menyimpan dana yang diterima dari Anggota Kliring Berjangka dalam rekening yang terpisah dari rekening milik Lembaga Kliring Berjangka pada bank yang disetujui oleh Bappebti; menjamin kerahsiaan informasi posisi keuangan serta kegiatan usaha Anggota Kliring Berjangka, kecuali informasi tersebut diberikan dalam rangka pelaksanaan ketentuan Undang-undang ini dan/atau peraturan pelaksanaannya; mendokumentasikan dan menyimpan semua data yang berkaitan dengan kegiatan Lembaga Kliring Berjangka; dan memantau kegiatan dan kondisi keuangan Anggota Kliring Berjangka serta mengambil tindakan pembekuan atau pemberhentian Anggota Kliring Berjangka yang tidak memenuhi persyaratan keuangan minimum dan pelaporan sesuai dengan ketentuan Undang-undang ini dan/atau peraturan pelaksanaannya. Sebelum diberlakukan, peraturan dan tata tertib Lembaga Kliring Berjangka sebagaimana dimaksud dalam Pasal 26 huruf b termasuk perubahannya, wajib memperoleh persetujuan dari Bappebti.

Kegiatan Lembaga Kliring Berjangka dihentikan apabila terjadi penghentian kegiatan transaksi di Bursa Berjangka secara tetap. sebagaimana dimaksud pada ayat (1), Bappebti mencabut izin usaha Lembaga Kliring Berjangka dan selanjutnya badan hukum Lembaga Kliring Berjangka yang bersangkutan dibubarkan, sesuai dengan peraturan perundang-undangan yang berlaku.

Kegiatan usaha sebagai Pialang Berjangka hanya dapat dilakukan oleh Anggota Bursa Berjangka yang berbentuk perseroan terbatas yang telah memperoleh izin usaha Pialang Berjangka dari Bappebti. Izin usaha sebagaimana dimaksud pada ayat (1),hanya diberikan kepada Anggota Bursa Berjangka yang memiliki integritas keuangan, reputasi bisnis yang baik, dan kecakapan profesi. Pelaksanaan kegiatan sebagaimana dimaksud pada ayat (1) dilakukan oleh orang perseorangan yang telah memperoleh izin Wakil Pialang Berjangka dari Bappebti.

Kegiatan usaha sebagai Penasihat Berjangka hanya dapat dilakukan oleh Pihak yang telah memperoleh izin usaha Penasihat Berjangka dari Bappebti. Izin usaha sebagaimana dimaksud pada ayat (1), hanya diberikan kepada Pihak yang memiliki kecakapan profesi yang tinggi, reputasi bisnis yang baik, dan integritas keuangan. Pelaksanaan kegiatan sebagaimana dimaksud pada ayat (1), untuk Penasihat Berjangka yang berbentuk badan usaha, dilakukan oleh orang perseorangan sebagai Wakil Penasihat Berjangka yang wajib memperoleh izin dari Bappebti.

Undang - Undang Republik Indonesia Nomor 32 Tahun 1997 : Bab V Sentra Dana Berjangka Dan Pengelola.

Sentra Dana Berjangka dibentuk berdasarkan kontrak antara Pengelola Sentra Dana Berjangka dan bank, yang mengikat peserta Sentra Dana Berjangka. Pembentukan Sentra Dana Berjangka wajib memperoleh persetujuan dari Bappebti. Semua kekayaan Sentra Dana Berjangka wajib disimpan pada bank, sebagaimana dimaksud pada ayat (1), yang selanjutnya disebut Bank Penitipan Sentra Dana Berjangka. Sebagai tanda bukti kepemilikan dana dalam Sentra Dana Berjangka, peserta memperoleh Sertifikat Penyertaan.

Sentra Dana Berjangka dilarang : menerima dan/atau memberikan pinjaman; dan/atau menggunakan dana Sentra Dana Berjangka untuk membeli Sertifikat Penyertaan dari Sentra Dana Berjangka lain.

Pengelola Sentra Dana Berjangka.

Kegiatan usaha sebagai Pengelola Sentra Dana Berjangka hanya dapat dilakukan oleh Pihak yang berbentuk perseroan terbatas yang wajib memperoleh izin usaha Pengelola Sentra Dana Berjangka dari Bappebti. Izin usaha Pengelola Sentra Dana Berjangka hanya diberikan apabila yang bersangkutan memiliki kemampuan dan integritas keuangan serta dikelola oleh orang perseorangan yang memiliki reputasi bisnis yang baik dan kecakapan profesi. Pelaksanaan kegiatan sebagaimana dimaksud pada ayat (1) dilakukan oleh orang perseorangan yang wajib memperoleh izin Wakil Pengelola Sentra Dana Berjangka dari Bappebti.

Pengelola Sentra Dana Berjangka bertugas mengelola portofolio investasi Sentra Dana Berjangka. Pengelola Sentra Dana Berjangka wajib dengan itikad baik dan penuh tanggung jawab melaksanakan tugas sebaik mungkin semata-mata untuk kepentingan Sentra Dana Berjangka. Apabila Pengelola Sentra Dana Berjangka tidak melaksanakan kewajibannya sebagaimana dimaksud pada ayat (1), Pengelola Sentra Dana Berjangka tersebut wajib bertanggung jawab atas segala kerugian yang timbul karena tindakannya.

Pengelola Sentra Dana Berjangka menjual Sertifikat Penyertaan secara terus menerus sampai dengan jumlah tertentu dan berdasarkan jangka waktu yang ditetapkan dalam kontrak. Pemegang Sertifikat Penyertaan dapat menjual kembali Sertifikat Penyertaan dan Pengelola Sentra Dana Berjangka wajib membeli kembali Sertifikat Penyertaan tersebut. Pengecualian ketentuan sebagaimana dimaksud pada ayat (2) hanya dapat dilakukan apabila : transaksi Kontrak Berjangka di Bursa Berjangka yang menjadi dasar investasi Sentra Dana Berjangka sebagian besar terhenti; ditetapkan dalam ketentuan kontrak pengelolaan Sentra Dana Berjangka.

Pengelola Sentra Dana Berjangka wajib menghitung nilai pasar wajar dari Kontrak Berjangka dalam portofolio Sentra Dana Berjangka tersebut untuk setiap hari kegiatan transaksi Bursa Berjangka berdasarkan ketentuan yang ditetapkan oleh Bappebti. Nilai Sertifikat Penyertaan ditentukan berdasarkan nilai aktiva bersih dan wajib diumumkan oleh Pengelola Sentra Dana Berjangka.

Pengelola Sentra Dana Berjangka dilarang : menyimpan kekayaan Sentra Dana Berjangka pada bank yang berafiliasi dengannya; dan/atau menggunakan jasa Pialang Berjangka yang berafiliasi dengannya.

Undang - Undang Republik Indonesia Nomor 32 Tahun 1997 : Bab VI Dana Kompensasi.

Bursa Berjangka wajib menghimpun dana dari Pialang Berjangka untuk Dana Kompensasi. Selain sumber dana sebagaimana dimaksud pada ayat (1), Dana Kompensasi dapat pula dihimpun dari sumber sah lain yang disetujui oleh Bappebti. Dana Kompensasi sebagaimana dimaksud pada ayat (1), wajib disimpan dalam rekening yang terpisah dari rekening Bursa Berjangka pada bank yang disetujui oleh Bappebti. Jumlah minimum Dana Kompensasi yang wajib dihimpun dan besar kontribusi setiap Anggota Bursa Berjangka yang berkedudukan sebagai Pialang Berjangka ditetapkan oleh Bursa Berjangka dengan persetujuan Bappebti. Dana Kompensasi yang telah disetorkan tidak dapat ditarik kembali.

Dana Kompensasi digunakan oleh Bursa Berjangka untuk membayar tuntutan ganti rugi kepada Nasabah yang bukan Anggota Bursa Berjangka yang timbul akibat cedera janji atau kesalahan yang dilakukan oleh Pialang Berjangka. Penggunaan Dana Kompensasi hanya dapat dipertimbangkan apabila: nasabah yang dirugikan telah berupaya melakukan penagihan secara langsung kepada Pilang Berjangka yang bersangkutan,, tetapi tidak berhasil; atau hasil penagihan tidak dipenuhi atau belum mencukupi jumlah ganti rugi yang selayaknya diterima oleh Nasabah yang bersangkutan. Pembayaran ganti rugi oleh Bursa Berjangka kepada Nasabah tidak mengurangi kewajiban Pialang Berjangka yang bersangkutan untuk: membayar kembali ganti rugi tersebut kepada Bursa Berjangka; dan membayar kepada Nasabah selisih antara ganti rugi tersebut dan jumlah yang selayaknya diterima apabila penagihan tidak dipenuhi seluruhnya, sebagaimana dimaksud pada ayat (2) huruf b. (4) Dana yang wajib dibayarkan oleh Pialang Berjangka sebagaimana dimaksud pada ayat (3), dapat dituntut sebagai utang Pialang Berjangka yang bersangkutan.

Apabila Bursa Berjangka dinyatakan pailit atau menghentikan kegiatan sesuai dengan ketentuan Undang-undang ini dan/atau peraturan pelaksanaannya, dana Kompensasi menjadi kekayaan Bursa Berjangka yang digunakan untuk membayar kewajiban Bursa Berjangka setelah semua pembayaran tuntutan ganti rugi kepada Nasabah atas Dana Kompensasi tersebut diselesaikan.

Ketentuan mengenai penghimpunan, penyimpanan, dan penggunaan Dana Kompensasi sebagaimana dimaksud dalam Pasal 45, Pasal 46, dan Pasal 47, diatur lebih lanjut dengan Peraturan Pemerintah.

Undang - Undang Republik Indonesia Nomor 32 Tahun 1997 : Bab VII Pelaksanaan Perdagangan Berjangka.

Setiap Pihak dilarang melakukan kegiatan Perdagangan Berjangka, kecuali kegiatan tersebut dilakukan berdasarkan ketentuan Undang-undang ini dan/atau peraturan pelaksanaannya. Setiap Pihak dilarang menyalurkan amanat untuk melakukan transaksi Kontrak Berjangka dari pihak ketiga, kecuali transaksi tersebut dilakukan berdasarkan ketentuan Undang-undang ini dan/atau peraturan pelaksanaannya.

Pialang Berjangka wajib mengetahui latar belakang, keadaan keuangan, dan pengetahuan mengenai Perdagangan Berjangka dari Nasabahnya. Pialang Berjangka wajib menyampaikan Dokumen Keterangan Perusahaan dan Dokumen Pemberitahuan Adanya Risiko serta membuat perjanjian dengan Nasabah sebelum Pialang Berjangka yang bersangkutan dapat menerima dana milik Nasabah untuk perdagangan Kontrak Berjangka. Pialang Berjangka dilarang menerima amanat Nasabah apabila mengetahui Nasabah yang bersangkutan: telah dinyatakan pailit oleh pengadilan; telah dinyatakan melanggar ketentuan Undang-undang ini dan/atau peraturan pelaksanaannya oleh badan peradilan atau Bappebti; pejabat atau pegawai; Bappebti, Bursa Berjangka, Lembaga Kliring Berjangka; atau Bendaharawan lembaga yang melayani kepentingan umum, kecuali yang bersangkutan mendapat kuasa dari lembaga tersebut. Pialang Berjangka dalam memberikan rekomendasi kepada Nasabah untuk membeli atau menjual Kontrak Berjangka wajib terlebih dahulu memberitahukan apabila ada kepentingan Pialang Berjangka yang bersangkutan.

Pialang Berjangka, sebelum melaksanakan transaksi Kontrak Berjangka untuk Nasabah, berkewajiban menarik Margin dari Nasabah untuk jaminan transaksi tersebut. Margin sebagaimana dimaksud pada ayat (1), dapat berupa uang dan/atau surat berharga tertentu. Pialang Berjangka wajib memperlakukan Margin milik Nasabah, termasuk tambahan dana hasil transaksi Nasabah yang bersangkutan, sebagai dana milik Nasabah. Dana milik Nasabah sebagaimana dimaksud pada ayat (3), wajib disimpan dalam rekening yang terpisah dari rekening Pialang Berjangka pada bank yang disetujui oleh Bappebti. Dana milik Nasabah hanya dapat ditarik dari rekening terpisah, sebagaimana dimaksud pada ayat (4), untuk pembayaran komisi dan biaya lain sehubungan dengan transaksi Kontrak Berjangka dan/atau untuk keperluan lain atas perintah tertulis dari Nasabah yang bersangkutan. Apabila Pialang Berjangka dinyatakan pailit, dana milik Nasabah yang berada dalam penguasaan Pialang Berjangka tidak dapat digunakan untuk memenuhi kewajiban Pialang Berjangka terhadap pihak ketiga atau kreditornya.

Pialang Berjangka dilarang melakukan transaksi Kontrak Berjangka untuk rekening Nasabah, kecuali telah menerima perintah tertulis untuk setiap kali transaksi dari Nasabah atau kuasanya yang ditunjuk secara tertulis untuk mewakili kepentingan Nasabah yang bersangkutan. Dalam hal tertentu, Bappebti dapat menetapkan bahwa Pialang Berjangka dapat pula melakukan transaksi atas Kontrak Berjangka untuk rekeningnya sendiri. Pialang Berjangka wajib mendahulukan transaksi Kontrak Berjangka atas amanat Nasabahnya.

Penasihat Berjangka berkewajiban mengetahui latar belakang, keadaan keuangan, dan pengetahuan mengenai Perdagangan Berjangka dari kliennya. Penasihat Berjangka wajib menyampaikan Dokumen Keterangan Perusahaan dan Dokumen Pemberitahuan Adanya Risiko kepada klien sebelum kedua pihak mengikatkan diri dalam suatu perjanjian pemberian jasa. Penasihat Berjangka dilarang menarik atau menerima uang dan/atau surat berharga tertentu dari kliennya, kecuali untuk pembayaran jasa atas nasihat yang diberikan kepada klien yang bersangkutan. Penasihat Berjangka dalam memberikan rekomendasi kepada klien untuk membeli atau menjual Kontrak Berjangka wajib terlebih dahulu memberitahukan apabila ada kepentingan Penasihat Berjangka yang bersangkutan.

Pengelola Sentra Dana Berjangka berkewajiban mengetahui latar belakang, keadaan keuangan, dan pengetahuan mengenai Perdagangan Berjangka dari peserta Sentra Dana Berjangka. Pengelola Sentra Dana Berjangka wajib menyampaikan Dokumen Keterangan Perusahaan dan Dokumen Pemberitahuan Adanya Risiko kepada calon peserta Sentra Dana Berjangka sebelum kedua pihak mengikatkan diri dalam suatu perjanjian pengelolaan Sentra Dana Berjangka. Pengelola Sentra Dana Berjangka wajib mengelola setiap Sentra Dana Berjangka dalam suatu lembaga yang terpisah dari Pengelola Sentra Dana Berjangka yang bersangkutan. Pengelola Sentra Dana Berjangka wajib menempatkan dana bersama yang dihimpun dari calon peserta Sentra Dana Berjangka dalam rekening yang terpisah dari rekening Pengelola Sentra Dana Berjangka yang bersangkutan pada bank yang disetujui oleh Bappebti.

Pialang Berjangka, Penasihat Berjangka, dan Pengelola Sentra Dana Berjangka wajib menjamin kerahasiaan data dan informasi mengenai Nasabah, klien, atau peserta Sentra Dana Berjangka, dan dilarang mengungkapkan data dan informasi tersebut, kecuali memperoleh persetujuan tertulis dari Nasabah, klien, atau peserta Sentra Dana Berjangka yang bersangkutan atau diwajibkan oleh peraturan perundang-undangan yang berlaku.

Praktik Perdagangan yang Dilarang.

Dalam Perdagangan Kontrak Berjangka setiap Pihak dilarang melakukan atau berusaha melakukan manipulasi melalui tindakan: baik secara langsung maupun tidak langsung dalam waktu bersamaan menguasai sebagian besar persediaan Komoditi secara fisik dan Kontrak Berjangka dengan posisi beli; baik secara langsung maupun tidak langsung membeli atau menjual Kontrak Berjangka yang dapat menyebabkan seolah-olah terjadi perdagangan yang aktif atau yang mengakibatkan terciptanya informasi yang menyesatkan mengenai keadaan pasar atau harga Kontrak Berjangka di Bursa Berjangka; membuat, menyebarkan, dan/atau menyuruh orang lain membuat dan/atau menyebarluaskan pernyataan atau informasi yang tidak benar atau menyesatkan yang berkaitan dengan transaksi Kontrak Berjangka dengan maksud mengambil keuntungan dari timbulnya gejolak harga di Bursa Berjangka akibat tersebarluasnya pernyataan atau informasi tersebut. Setiap Pihak dilarang: melakukan transaksi Kontrak Berjangka yang telah diatur sebelumnya secara tidak wajar; menyelesaikan dua atau lebih amanat nasabah yang berlawanan untuk Kontrak Berjangka yang sama di luar Bursa Berjangka; secara langsung atau tidak langsung menjadi lawan transaksi Nasabahnya, kecuali: amanat Nasabah telah ditawarkan di Bursa Berjangka secara terbuka; dan transaksi yang terjadi dilaporkan, dicatat, dan dikliringkan dengan cara yang sama sebagaimana amanat lain yang ditransaksikan di Bursa Berjangka; atau secara langsung atau tidak langsung mempengaruhi pihak lain untuk melakukan transaksi Kontrak Berjangka dengan cara membujuk atau memberi harapan keuntungan di luar kewajaran.

Setiap Pihak dilarang memiliki, baik secara langsung maupun tidak langsung, posisi terbuka atas Kontrak Berjangka yang melebihi batas maksimum. Batas maksimum sebagaimana dimaksud pada ayat (1), ditetapkan oleh Bappebti.

Setiap Pihak wajib melaporkan kepada Bappebti melalui Bursa Berjangka posisi terbuka Kontrak Berjangka yang dimilikinya apabila mencapai batas tertentu yang ditetapkan oleh Bappebti.

Penyelesaian Perselisihan Perdata.

musyawarah untuk mencapai mufakat di antara Pihak yang berselisih; atau pemanfaatan sarana yang disediakan oleh Bappebti dan/atau Bursa Berjangka apabila musyawarah untuk mencapai mufakat, sebagaimana dimaksud pada huruf a, tidak tercapai.

Trading Forex Dengan Analisa Intermarket (1)

Intermarket berarti hubungan dan interaksi antara berbagai jenis pasar dengan instrument tradingnya masing-masing. Pergerakan harga dari berbagai jenis pasar tersebut saling mempengaruhi satu sama lain, misalnya antara pasar saham dan pasar komoditi, antara pasar komoditi dan pasar forex, dan lain sebagainya. Para trader forex profesional selalu menerapkan metode analisa intermarket guna memaksimalkan keuntungan dan mengurangi resiko akibat pengaruh salah satu jenis pasar terhadap pasar forex. Selain itu trader forex juga bisa melakukan hedging posisi tradingnya dengan masuk pada jenis pasar yang lain.

Prinsip Dasar Analisa Intermarket.

Dalam pasar keuangan dunia, ada 4 instrument yang saling mempengaruhi satu sama lain, yaitu indeks harga saham, harga dan yield bond (bond pemerintah atau bond corporate besar), harga komoditi utama dunia dan pasangan beberapa mata uang utama (terhadap USD maupun yang cross currency ). Indeks harga saham digunakan untuk mengetahui arah perputaran uang dalam ekonomi global. Dalam keadaan normal, jika indeks harga saham suatu negara menguat maka nilai mata uang negara tersebut juga akan menguat, dan sebaliknya. Harga bond dan yield bond digunakan untuk mengetahui gambaran pergerakan tingkat suku bunga suatu negara. Harga komoditi utama dunia digunakan untuk mengetahui gambaran tingkat inflasi, tingkat permintaan dan penawaran ( demand and supply ) pada beberapa negara eksportir utama dan importir utama komoditi dunia.

Hubungan Antara Indeks Harga Saham Dan Pasangan Mata Uang.

Pasar saham adalah acuan utama pasar keuangan, dan indeks harga saham mewakili tingkat harga saham-saham utama ( blue chips ) suatu negara. Untuk membeli saham suatu negara, kita harus menggunakan mata uang negara tersebut. Untuk melakukan investasi pada saham-saham utama Jepang, investor dari Eropa harus menukarkan mata uang Euro-nya dengan Yen Jepang. Permintaan Yen Jepang yang meningkat menyebabkan nilai tukarnya naik, sebaliknya penjualan mata uang Euro menyebabkan supply-nya meningkat sehingga nilai tukarnya berkurang.

Sebelum resesi ekonomi global yang dimulai tahun 2007, indeks harga saham Nikkei dan mata uang JPY memang searah, atau indeks Nikkei dan USD/JPY bergerak berlawanan atau dengan korelasi negatif, sehingga jika indeks Nikkei menguat maka JPY juga menguat (USD/JPY melemah). Namun setelah terjadi krisis keuangan yang diikuti oleh resesi global, korelasi indeks Nikkei dan USD/JPY berubah menjadi positif yang berarti jika indeks Nikkei menguat maka JPY melemah (USD/JPY menguat). Ada berbagai faktor yang menyebabkan hal tersebut bisa terjadi, yang tidak diulas dalam serial artikel ini. Biasanya indeks harga saham digunakan untuk trading forex jangka menengah dan panjang karena dampaknya biasanya memang tidak tampak dalam jangka pendek. Dalam jangka pendek biasanya uang berdampak adalah rilis data fundamental, berita dan komentar para petinggi bank sentral.

Maksudnya perubahan tingkat suku bunga sudah bisa diprediksikan jauh hari dari perubahan yield bond. Jika bond ditransaksikan pada yield yang lebih tinggi maka bisa diprediksikan suku bunga akan naik, dan sebaliknya jika bond ditransaksikan pada yield yang lebih rendah maka bisa diprediksikan suku bunga akan turun.
